Michael Jordan Testifies He Felt No Fear of Nascar in Legal Battle
The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, admitted that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to confront Nascar over perceived violations of competition laws.
Team Investment and a Competitive Drive
The owner disclosed operational insights of his 23XI team, saying he invested $40m of his own funds into the Cup Series operation co-founded with business partner Curtis Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan said in the Charlotte courtroom. “I was a new person, I had no fear. I felt I could challenge Nascar in its entirety. I felt as far as the sport required examination from a different view.”
The Core Dispute: Franchise System and Renewal Demands
The heart of the case involves the end of a 2016 agreement where Nascar granted each team a “charter”. The concept is similar to other major leagues with separately owned franchises, like the Charlotte Hornets or the Carolina Panthers. This deal was due to end in 2024 when Nascar insisted on charter membership renewals.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to pandemonium, with fans and media clamoring for a view or a photo of the global icon.
Leading the Legal Charge
Jordan’s 23XI is at the forefront of the push along with another racing team for Nascar to change a business model Jordan said is unlawful to maintain excessive control.
At issue for Jordan and a fellow team representative, who preceded Jordan, are details from last September. Gibbs described a hectic and tense six hours where the sanctioning body told teams they must sign a contract extension. This agreement consists of over a hundred pages detailing team compensation and a guaranteed spot in Nascar-sponsored races.
A Refusal to Sign
Jordan said that his team and its ally concluded their only feasible option was to refuse a signature that extensive document and take the issue to court. The other 13 organizations signed the agreement.
Jordan and co-owner Denny Hamlin approached Nascar about potential amendments or negotiations. Nascar wasn’t talking, Jordan said.
The Bottom Line: Winning
Ultimately, the pushback against what he saw as a financially unsustainable model was mostly about the familiar goal for Jordan: Success.
“Denny convinced me getting a third driver improved our chances to win,” he testified, sharing that he purchased another franchise late in 2024 for $28m despite the uncertainty. “So I dove in.”
Heather Gibbs’ Testimony
Heather Gibbs detailed her request for permanent charters, which she said a formal letter to Nascar. She testified the timing of the contract signing demand was problematic.
She said, Joe Gibbs first attempted to call and talk Nascar out of forcing signatures, but Nascar’s leader declined the request.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s executives. She said France replied, “Whether I have 20 charters, I have 20. If I have 30, I have 30.”
